This essay contributes to the ethics of vulnerability and to the tradition of feminist care ethics by introducing the notion of second-person needs. Employing the work of Annette Baier, who argues that we are all ‘second persons’ insofar as personhood arises through a childhood in the care of others, it draws attention to the needs that are illuminated when we approach ourselves and others as second persons, and makes a case for the moral import of second-person needs. In drawing from (...) and critically responding to Lisa Tessman’s concept of ‘burdened virtues,’ it also adds to a growing field of ethical work on moral damage. In particular, this paper reminds readers of the benefits of the virtue of sensitivity and attention to other’s suffering, without ignoring the toll that it can extract. (shrink)

Scholars studying the ethical, legal, and social issues associated with emerging technologies maintain the importance of considering these issues throughout the research and development cycle, even during the earliest stages of basic research. Embedding these considerations within the scientific process requires communication between ELSI scholars and the community of physical scientists who are conducting that basic research. We posit that this communication can be effective on a broad scale only if it links societal issues directly to characteristics of the emerging (...) technology that are relevant to the physical and natural scientists involved in research and development. In this article, we examine nano-ELSI literature from 2003 to 2010 to discern the degree to which it makes these types of explicit connections. We find that, while the literature identifies a wide range of issues of societal concern, it generally does so in a non-specific manner. It neither links societal issues to particular forms or characteristics of widely divergent nanotechnologies nor to any of the many potential uses to which those nanotechnologies may be put. We believe that these kinds of specificity are essential to those engaged in nano-scale research. We also compare the literature-based findings to observations from interviews we conducted with nanoscientists and conclude that ELSI scholars should add technical- and application-related forms of specificity to their work and their writings to enhance effectiveness and impact in communicating with one important target audience—members of the nanoscale science community. Following a pattern of racially-motivated social violence enacted during the time of slavery and critiqued by many Black feminist thinkers, this paper argues that numerous U.S. immigration policies today inflict unjust and deeply damaging forms of relational deprivation on immigrant workers and their care communities. One form this relational deprivation takes is that of impinging on the ability to directly provide care to, or otherwise express care for, those whom one loves. When we recognize that caring for those that one (...) loves is both a precious form of freedom and a genuine need, we establish the foundation for understanding how the shackling of this cherished ability can result in egregious injustice and harm. In highlighting this form of relational deprivation and others, the paper thus makes a case for why immigration policies must change. (shrink)

Enhancing body awareness has been described as a key element or a mechanism of action for therapeutic approaches often categorized as mind-body approaches, such as yoga, TaiChi, Body-Oriented Psychotherapy, Body Awareness Therapy, mindfulness based therapies/meditation, Feldenkrais, Alexander Method, Breath Therapy and others with reported benefits for a variety of health conditions. To better understand the conceptualization of body awareness in mind-body therapies, leading practitioners and teaching faculty of these approaches were invited as well as their patients to participate in focus (...) groups. The qualitative analysis of these focus groups with representative practitioners of body awareness practices, and the perspectives of their patients, elucidated the common ground of their understanding of body awareness. For them body awareness is an inseparable aspect of embodied self awareness realized in action and interaction with the environment and world. It is the awareness of embodiment as an innate tendency of our organism for emergent self-organization and wholeness. The process that patients undergo in these therapies was seen as a progression towards greater unity between body and self, very similar to the conceptualization of embodiment as dialectic of body and self described by some philosophers as being experienced in distinct developmental levels. Connections between one's own welfare and that of others abound if we pause to look for them, although philosophical theories of selfhood have only very recently begun to incorporate these connections. This essay draws on recent work on need to argue that one of the strongest expressions of these connections is to be found in the relational needs that they can generate. While paying heed to needs that arise from the relational nature of selfhood at large, this essay pays particular (...) attention to what I call “transpersonal needs”: needs that occur when one's experience of the needs of others gives rise to certain needs of one's own. I argue that the best criterion for defining need is vulnerability to harm, but this does not mean that having a need is something that is purely harmful. Having certain needs can also enrich one's life. Further, while every need entails a corresponding vulnerability to harm, some of these potential harms are more detrimental to one's welfare than others, with some relational needs standing among those that can result in the greatest harm if unanswered. Peter Singer has long contended it is “speciesist” to regard all human life as of equal moral worth, maintaining that the moral value of life itself hinges on certain intellectual and psychological capacities. I argue that “speciesism” can be wrested from the ableism with which Singer aligns this term of critique and reclaimed as an important term of ethical analysis serving the interests of both animal ethics and disability bioethics alike, but the term must be extracted from capacity-based moral reasoning (...) to do so. Beginning with a study of need and its relationship to violence in Sartre’s Critique of Dialectical Reason, this paper argues that need, in the midst of scarcity, can both be a catalyst for violence and a force in the service of love. It warns against an antagonistic view of need and of ethics that emerges in Sartre’s Critique, drawing on Sartre’s own ongoing commitments to existentialism and also on the work of Primo Levi. In particular, it warns against the danger (...) of reducing an ethics of need to one of Manichean violence. It also introduces the concept of ‘second-person needs’, which include needs of one’s own for the needs of others to be met. This concept is resonant with the idea of authentic love introduced in Sartre’s earlier, unfinished Notebooks for an Ethics, with the suggestions concerning a concrete, material ethics offered in Sartre’s Rome Lecture of 1964, as well as with Sartre’s concept of the fused group in the Critique itself. The care ethics tradition has long argued for the merits of understanding the self as relational. Inspired by this tradition, but also by ecofeminist philosophies that insist on the need to consider our wider ecological and interspecies connections, this paper focuses on the relational elements of breast/chestfeeding and their ethical implications. I show nursing to be an act that not only 1) connects us to one another through bonds of nourishment and care but also 2) reconnects us to our animal (...) selves and enlivens connections to non-human animals. Moreover, I argue that nursing 3) exposes our entwinement in a web of ecological relationships through which the toxic harm we have wrought on our environment returns to us. To draw out the ethical implications of these connections, I introduce the concept of ‘relational vulnerabilities.’ Relational vulnerabilities are forged through our connections to others, be they bonds of dependence and need, historical harm and ongoing violence, love and joy, or all at once. I contend that all relational vulnerabilities call for ethical attention, yet, when it comes to nursing, these vulnerabilities are often neglected or, worse, made the targets of heinous abuse. This article traces my own pedagogical journey to find strategies for teaching critical thinking that emphasize intellectual cooperation, empathy, and argument repair, a journey that found me frequently turning to sources outside of philosophy, including work in intergroup dialogue and pedagogical work in rhetoric and composition. Theoretically, the article showcases Maureen Linker’s notion of ‘cooperative reasoning’, sets it against the ‘adversary paradigm’ Janice Moulton critiques, and illustrates how Peter Elbow’s challenges to critical thinking as a ‘doubting game’ resonate with Linker’s (...) work. Practically, it illustrates the structure and the role of peer-to-peer dialogues in my own reasoning classroom, an enactment of a cooperative, belief-based approach to reasoning inspired by Linker and Elbow alike, while also learning from the methodologies of intergroup dialogue. Human genomics is a translational field spanning research, clinical care, public health, and direct-to-consumer testing. However, law differs across these domains on issues including liability, consent, promoting quality of analysis and interpretation, and safeguarding privacy. Genomic activities crossing domains can thus encounter confusion and conflicts among these approaches. This paper suggests how to resolve these conflicts while protecting the rights and interests of individuals sequenced. Translational genomics requires this more translational approach to law.

For example, our understanding of how HIV is transmitted and how to prevent it only came about with people's willingness to share information about their sexual and drug-using behaviors. Given the scientific need for sensitive, personal information, researchers have a corresponding ethical and legal obligation to maintain the confidentiality of data they collect and typically promise in consent forms to restrict access to it and not to publish (...) identifying data.The interests of others, however, can threaten researchers' promises of confidentiality when legal demands are made to access research data. In some cases, the subject of the litigation is tightly connected to the research questions, and litigants' interest in the data is not surprising. Researchers conducting studies on tobacco or occupational or other chemical exposures, for example, are relatively frequent targets of subpoenas. (shrink)

Proposed educational outcomes for the health humanities in medical education range from empathy to visual thinking skills to social accountability. This lack of widely agreed-upon high-level curricular goals limits humanities educators’ ability to design purposeful curricula toward clear, common ends and threatens justifications for scarce curricular time. We propose a novel approach to the hoped-for outcomes of health humanities training in medical schools, which has the potential to encompass traditional health humanities knowledge, skills, and behaviors while also being concrete and (...) measurable: humanistic practice. Humanistic practice, adapted from the concept of ethical sensitivity, is an intentional process of applying humanities knowledge and skills to a clinical scenario by 1) noticing that the scenario requires humanities knowledge or skills, 2) informing one’s clinical and interpersonal strategy and behavior with humanities knowledge or skills, 3) reflecting on the effectiveness of the strategy and behavior, and 4) reorienting to develop new approaches for future practice. The construct of humanistic practice may help address some of the foundational problems in health humanities outcomes research since it transcends the traditional diverse content domains in the health humanities, can link patient and provider experiences, and may bridge the divide among the additive, curative, and intrinsic epistemic positions of humanities to medical education. This article asserts the need for the ethical analysis of regulatory policy. The article explores the conventional wisdom surrounding the proper role of government, the function of law, the role of lawmakers, the nature of business, and the relationship between business and government. It is the traditional thinking regarding these fundamental aspects of our social life which creates barriers to the ethical analysis of regulatory policy. It is argued that, in spite of the persistence of agency theories of the firm, (...) a stakeholder theory of the firm best approximates a true descriptive and normative view of business organizations. If the role of government is to maximize the full range of public — private relationships for any given series of inputs, and the role of the firms is to maximize the balance of diverse stakeholders' interests, then a stakeholders' interests paradigm becomes the natural foundation for the ethical analysis of policies which regulate business. Nanomedicine is yielding new and improved treatments and diagnostics for a range of diseases and disorders. Nanomedicine applications incorporate materials and components with nanoscale dimensions where novel physiochemical properties emerge as a result of size-dependent phenomena and high surface-to-mass ratio. Nanotherapeutics and in vivo nanodiagnostics are a subset of nanomedicine products that enter the human body. These include drugs, biological products, implantable medical devices, and combination products that are designed to function in the body in ways unachievable at larger scales. (...) Nanotherapeutics andin vivonanodiagnostics incorporate materials that are engineered at the nanoscale to express novel properties that are medicinally useful. These nanomedicine applications can also contain nanomaterials that are biologically active, producing interactions that depend on biological triggers. Examples include nanoscale formulations of insoluble drugs to improve bioavailability and pharmacokinetics, drugs encapsulated in hollow nanoparticles with the ability to target and cross cellular and tissue membranes and to release their payload at a specific time or location, imaging agents that demonstrate novel optical properties to aid in locating micrometastases, and antimicrobial and drug-eluting components or coatings of implantable medical devices such as stents. These books will introduce readers to major problems and alternative ways of dealing with those problems. These books, however, will differ from most in that they will evaluate alternative viewpoints not only with regard to their general strength, but also with regard to their value in the construction of a Christian world and life view. Thus, the books will explore the implications of (...) the various views for Christian theology as well as the implications that Christian convictions might have for the philosophical issues discussed. The success of deep brain stimulation (DBS) for movement disorders and the improved understanding of the neurobiologic and neuroanatomic bases of psychiatric diseases have led to proposals to expand current DBS applications. Recent preclinical and clinical work with Alzheimer's disease and obsessive-compulsive disorder, for example, supports the safety of stimulating regions in the hypothalamus and nucleus accumbens in humans. These regions are known to be involved in addiction and overeating associated with obesity. However, the use of DBS targeting these areas (...) as a treatment modality raises common ethical considerations, which include informed consent, coercion, enhancement, threat to personhood, and manipulation of the reward center. Pilot studies for both of these conditions are currently investigational. If these studies show promise, then there is a need to address the ethical concerns related to the initiation of clinical trials including the reliability of preclinical evidence, patient selection, study design, compensation for participation and injury, cost-effectiveness, and the need for long-term follow-up. Multidisciplinary teams are necessary for the ethical execution of such studies. In addition to establishing safety and efficacy, the consideration of these ethical issues is vital to the adoption of DBS as a treatment for these conditions. We offer suggestions about the pursuit of future clinical trials of DBS for the treatment of addiction and overeating associated with obesity and provide a framework for addressing ethical concerns related to treatment. This article explores Nicolas Malebranche's approach to fashion: an inescapable postlapsarian consequence of God's sociable design of the human mind and body as manifested in the imagination. A problematic side effect of the general laws established by God governing the soul-body relationship, fashion wreaked havoc on individuals' thinking and potential for redemption yet pointed to a larger providential plan for social benefit. These ideas led Malebranche to a distinctive nonpolitical approach to fashion—both “Enlightenment project” and theodicy—in which he sought to (...) promote, toward human liberation and salvation, an enlightened understanding of the processes that created fashion and a charitable approach to managing it. Ultimately, however, his brain-based analysis ended up limiting individual freedoms (imaginative, cognitive, and behavioral), notably for those endowed with certain kinds of minds, in ways that had long-lasting effect. It also helped lay foundations for the Enlightenment's conflicted views about fashion as individual folly and beneficial social phenomenon. -/- Cet article montre que, pour Nicolas Malebranche, la mode constitua une conséquence inévitable de la Chute et du dessin sociable et providentiel de l'esprit et du corps, manifesté dans l'imagination. Effet secondaire et problématique des lois générales établies par Dieu pour gouverner les relations entre l'esprit et le corps, la mode entrave la réflexion et l'accès au salut tout en dessinant un plan providentiel, au bénéfice de tous.
